Legal information

Terms & Conditions

These terms govern use of the doctor portal and every custom laboratory case submitted to By Design Dental Lab.

Effective August 21, 2026Version 2026.08

Important no-return policy

Custom restorations are final sale.

Every restoration is fabricated for a specific patient from the prescribing doctor's scans, records and instructions. Once digital design, material preparation or fabrication begins, the order cannot be returned, exchanged or cancelled, and payments are non-refundable, except where applicable law requires otherwise or By Design Dental Lab agrees in writing.

1. Acceptance and authorized use

These Terms & Conditions apply to the public website, account registration, doctor portal, appointment requests and laboratory orders offered by By Design Dental Lab. By creating an account, submitting a case or authorizing production, you accept these terms for yourself and the dental practice you represent. Portal users must be authorized by the practice and legally permitted to submit the applicable prescription or clinical instructions.

2. Doctor and clinical responsibilities

By Design Dental Lab fabricates work according to the records and prescription supplied by the treating doctor. The doctor remains responsible for diagnosis, treatment planning, material selection, tooth preparation, clinical fit verification, patient consent and final delivery to the patient. Laboratory feedback supports collaboration and does not replace the doctor's independent clinical judgment.

3. Case submission and production approval

The submitting practice must provide complete and accurate prescriptions, scans, photographs, shade information, selected teeth, due dates and other records needed for the case. A portal submission is a request for laboratory work; production timing and final pricing are confirmed after review. Corrections, new instructions or scope changes may change the completion date and price.

Identify the patient by full name or an internal case reference.
Review every prescription and file before authorizing production.

4. Quality concerns, adjustments and remakes

The no-return policy does not remove our commitment to the workmanship specified in the accepted case. A suspected fabrication or material issue must be reported in writing within seven calendar days after delivery and, whenever clinically possible, before seating, cementation, alteration or patient use. Include the case number, description and supporting photographs or records.

We may require the restoration and relevant records for evaluation. When we confirm that delivered work materially differs from the accepted prescription because of laboratory workmanship, the available remedy may be an adjustment, remake or account credit selected after review. This review process is not a general right of return and does not provide a cash refund.

A new charge may apply when the issue results from incomplete or inaccurate records, a new scan or impression, preparation or tissue changes, a changed shade or design request, clinical adjustment, misuse, accident, normal wear or failure to follow handling instructions.

5. Pricing, payment and delivery

By default a case is charged the same day to the card on file and is not sent to the laboratory if that charge does not succeed. Monthly invoicing is available only after the laboratory approves a billing arrangement. Approved monthly accounts are invoiced according to those terms. Custom restorations are not refundable except where required by law. Portal amounts are estimates unless identified as a final invoice. The practice is responsible for approved laboratory charges, applicable taxes, priority fees, additional materials and delivery expenses disclosed for the case. Completion and delivery dates are good-faith estimates and may change if records are incomplete, instructions change or circumstances outside our reasonable control occur.

6. Files, privacy and account security

The practice represents that it has the authority and patient permissions needed to transmit clinical photographs, scans and other records to the laboratory. Users must protect account credentials, restrict portal access to authorized personnel and promptly report suspected unauthorized access. Do not place unnecessary identifiers in filenames.

7. Website and portal availability

We may maintain, update or temporarily suspend parts of the website or portal. Users are responsible for retaining any records their practice is legally required to keep. Website content and availability do not guarantee acceptance of a case or a particular clinical outcome.

8. Affiliate program

Approved affiliates may introduce new dental practices using their assigned referral code or portal. Unless a separate written agreement states otherwise, eligible collected sales earn a 5% commission through $10,000 in approved sales during a commission cycle. After approved sales exceed $10,000, the 10% rate applies to the full approved sales total for that cycle. Taxes, delivery charges, cancelled cases, chargebacks, complimentary work, duplicate leads and existing clients are excluded.

Affiliates must make truthful statements, may not provide clinical advice or guarantee results, and must clearly disclose that they may receive a commission when recommending By Design Dental Lab. Fraudulent referrals, self-referrals, misleading claims or manipulation of sales may void commissions and result in suspension or termination.

9. Intellectual property

The By Design Dental Lab name, branding, website, portal design and original content are owned by or licensed to By Design Dental Lab. A practice retains its rights in the clinical records it submits and grants us permission to use those records only as reasonably necessary to evaluate, fabricate, document, deliver and support the requested case.

10. Limits and non-waivable rights

To the fullest extent permitted by law, neither party is responsible for indirect, incidental or consequential losses arising from use of the website or portal. Nothing in these terms excludes or limits a right, remedy or liability that applicable law does not permit the parties to waive.

11. Applicable law, updates and contact

These terms are governed by Florida law, without regard to conflict-of-law principles. Any permitted court proceeding relating to these terms will be brought in Miami-Dade County, Florida. We may update these terms prospectively by publishing a new effective date. Material changes will apply to cases submitted after the updated terms are presented for acceptance.

Questions or quality concerns should be sent to bydesignco01@gmail.com with the applicable case number.
